TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO CASE SHALL Isotech , OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS OR LICENSORS, OR THOSE OF SHOPIFY AND ITS AFFILIATES, BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING, WITHOUT LIMITATION, LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, REPLACEMENT COSTS, OR ANY SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, ARISING FROM YOUR USE OF ANY OF THE SERVICES OR ANY PRODUCTS PROCURED USING THE SERVICES, OR FOR ANY OTHER CLAIM RELATED IN ANY WAY TO YOUR USE OF THE SERVICES OR ANY PRODUCT, INCLUDING, BUT NOT LIMITED TO, ANY ERRORS OR OMISSIONS IN ANY CONTENT, OR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF THE SERVICES OR ANY CONTENT (OR PRODUCT) POSTED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE SERVICES, EVEN IF ADVISED OF THEIR POSSIBILITY.

SECTION 18 - INDEMNIFICATION
You agree to indemnify, defend and hold harmless Isotech , Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities or claims, including reasonable attorneys' fees, payable to any third party due to or arising out of (1) your breach of these Terms of Service or the documents they incorporate by reference, (2) your violation of any law or the rights of a third party, or (3) your access to and use of the Services.
We will notify you of any indemnifiable claim, provided that a failure to promptly notify will not relieve you of your obligations unless you are materially prejudiced. We may control the defense and settlement of such claim at your expense, including choice of counsel, but will not settle any claim requiring non-monetary obligations from you without your consent (not to be unreasonably withheld). You will cooperate in the defense of indemnified claims, including by providing relevant documents.

SECTION 19 - SEVERABILITY
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
These Terms of Service and any policies or operating rules posted by us on this site or in respect to the Service constitutes the entire agreement and understanding between you and us and governs your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

You and Isotech consent to venue and personal jurisdiction in such courts.

Se entiende por compra de bienes la venta de bienes a un consumidor que no actúa principalmente en el ejercicio de una actividad comercial, y cuando el vendedor actúa en el ejercicio de una actividad comercial al vender bienes por internet. • • El acuerdo

 

 

El acuerdo entre el comprador y el vendedor se compone de la información proporcionada por el vendedor sobre la compra en la plataforma de pedidos de la tienda en línea (que incluye, entre otros aspectos, información sobre la naturaleza, cantidad, calidad, otras características, precio y plazos de entrega de los productos), cualquier comunicación directa entre las partes (por ejemplo, correo electrónico) y las presentes condiciones de venta. En caso de conflicto entre la información proporcionada por el vendedor sobre la compra en la plataforma de pedidos de la tienda en línea, la comunicación directa entre las partes y las condiciones de venta, prevalecerá la información proporcionada en la plataforma de pedidos, salvo que entre en conflicto con la legislación vigente. La tienda en línea de ISOTECH no puede celebrar acuerdos con menores de edad sin la autorización de un tutor legal. Los precios indicados en la tienda online incluyen el IVA. ISOTECH se reserva el derecho a corregir cualquier error en los precios de la tienda online. El acuerdo es vinculante para ambas partes una vez que el vendedor haya recibido el pedido del comprador. Sin embargo, una de las partes no estará obligada por el acuerdo si se ha producido un error tipográfico en la oferta del vendedor en la plataforma de pedidos en línea o en el pedido del comprador, y la otra parte se percató o debería haberse percatado de dicho error. ISOTECH también se reserva el derecho de informar al cliente, por correo electrónico o por teléfono, tan pronto como lo tengamos en cuenta, en caso de que algún artículo esté agotado.

 

Confirmación del pedido: Una vez recibido el pedido del comprador, el vendedor lo confirmará sin demora mediante una confirmación. Se recomienda al comprador verificar que la confirmación coincida con el pedido en cuanto a cantidad, tipo de producto, precio, etc. Si existe alguna discrepancia entre el pedido y la confirmación, el comprador deberá contactar al vendedor lo antes posible.

 

El vendedor puede exigir el pago de los bienes en el momento del pedido. Todas nuestras transacciones se realizan en coronas noruegas. Si el comprador utiliza una tarjeta de crédito para el pago, el vendedor puede reservar el precio de compra en la tarjeta en el momento del pedido.

Devoluciones de productos

 

Tras la entrega del producto, toda la responsabilidad recae sobre el comprador.
ISOTECH no se responsabiliza de los daños o devoluciones que puedan producirse debido a las condiciones de almacenamiento.
Por este motivo, no se admiten devoluciones ni reembolsos.

 

ISOTECH no se responsabiliza de los problemas que puedan surgir por un uso incorrecto por parte del comprador. Por lo tanto, no se admiten devoluciones, reclamaciones ni cambios de producto.

 

Corrección o reparación de un defecto . Artículo 29 del Código de Comercio noruego o artículo 34 del mismo código. El comprador no podrá exigir la corrección si esta resulta imposible o supone costes o inconvenientes desproporcionados para el vendedor.

 

Entrega
La entrega de la mercancía del vendedor al comprador se realiza de la forma y en el lugar especificados en la solución de pedido en la tienda online. Si no se indica un plazo de entrega en la solución de pedido, el vendedor entregará la mercancía al comprador en un plazo razonable, que normalmente es de 3 a 5 días hábiles y no más tarde de 30 días después de la recepción del pedido. Si ISOTECH no puede entregar en el plazo acordado, se informará al comprador sin demora del motivo del retraso y de un nuevo plazo de entrega. El comprador tendrá entonces derecho a cancelar la compra sin cargo alguno, a exigir que se complete la compra o a solicitar un producto de reemplazo al vendedor. Si el comprador no acepta un nuevo plazo de entrega, en caso de retraso en la entrega, se le reembolsará la compra en un plazo de 14 días.
Si el vendedor se encarga del envío de la mercancía al comprador, está obligado a transportarla al destino de forma adecuada y en las condiciones habituales para dicho transporte. El destino es el comprador, salvo que las partes acuerden específicamente lo contrario.

 

 El riesgo de la
mercancía se transfiere al comprador cuando este la recibe conforme al acuerdo. Si transcurrido el plazo de entrega el comprador no recibe la mercancía que se le ha entregado según lo estipulado en el acuerdo, seguirá asumiendo el riesgo de pérdida o daño debido a las características propias de la mercancía.

 

 Resolución de conflictos
Las partes intentarán resolver cualquier disputa de forma amistosa. El comprador podrá contactar con el Consejo del Consumidor para obtener ayuda en caso de disputa con el vendedor. Si no se alcanza una solución amistosa tras la mediación en el Consejo del Consumidor, las partes podrán solicitar por escrito que este remita la disputa al Comité de Controversias del Consumidor. Las decisiones del Comité de Controversias del Consumidor serán jurídicamente vinculantes cuatro semanas después de su notificación. ISOTECH acatará las decisiones del Comité de Controversias del Consumidor.
